Terms and Conditions of Use

  1. Overview

This website is operated by Romain Mas, trading as Wise Monkey Wear® (“we”, “us”, “our”), owner of the registered trade mark Wise Monkey Wear® and the associated mark Wise Monkey Wrought™ (together, “Wise Monkey Wear”).

By visiting our site or purchasing from us, you agree to be bound by these Terms and Conditions of Use (“Terms”). If you do not agree with any part of these Terms, you must not use this website or place an order.

Our store is built on WordPress and WooCommerce. Production and fulfilment are carried out by our independent print-on-demand partner in the United Kingdom.

  1. Eligibility and Use of the Website

You must be at least 18 years old to place an order. You may not use this website or our products for any illegal or unauthorised purpose.

You may not:

  • Use the site in a way that damages, overloads, or impairs its operation.
  • Interfere with server-side or database systems.
  • Attempt to gain unauthorised access to any part of the website.

Where you breach these Terms, or engage in activity we reasonably consider abusive, fraudulent, or unlawful, we may suspend or terminate your access to the site or your account, and may cancel any pending order.

  1. Products, Colours and Sizing

All products are made to order. Each item is printed after you place your order rather than held as stock.

We make every reasonable effort to display colours, details, and product descriptions accurately. However, slight variations may occur due to:

  • Monitor or device settings.
  • Print method (DTF or DTG).
  • Fabric texture and construction.

Sizes are indicative only and may vary within normal manufacturer tolerances. We recommend reviewing our size guide before ordering.

  1. Prices, Availability and Order Acceptance
  • All prices are displayed in British Pounds (£, GBP).
  • We reserve the right to change prices, withdraw or discontinue products, or correct pricing or product-description errors at any time without prior notice.
  • An order is accepted only once payment has cleared and you have received a confirmation email. Until that email is sent, the order is not binding.

In the event of a pricing or product-description error, we may:

  • Agree a fair resolution with you, or
  • Cancel the order and refund any payment made.
  1. Fulfilment and Delivery
  • Orders are printed and dispatched in the United Kingdom by our independent fulfilment partner.
  • Typical production and dispatch time: 3 to 7 working days.
  • We ship within the United Kingdom only.
  • Delivery times are estimates only.

We cannot accept liability for delays caused by:

  • Couriers or postal services.
  • Strikes, adverse weather, or natural events.
  • Incorrect or incomplete delivery addresses provided by the customer.

Shipping is a flat £3.95 on every order within the United Kingdom, and is shown at checkout. Estimated delivery windows apply after the order has been dispatched. For more detail on delivery and tracking, please see our Shipping Policy.

  1. Returns, Cancellations and Refunds

Change of mind

You may cancel your order for any reason, without giving one, from the moment you place it until 14 days after delivery. Once you have told us, you have a further 14 days to return the item.

We refund the price of the item and the delivery charge you paid. We issue the return label and cover the cost of returning the item to us, and nothing is deducted from your refund.

You may try the garment on, as you would in a fitting room. Trying on is not wearing. Items should be returned unwashed and free of marks, odours, hair, or any other sign of use. Where a garment has been worn rather than tried on, or washed, we may reduce the refund to reflect the loss in value.

Faulty, damaged, or misprinted items

If an item is faulty, misprinted, or damaged, we will arrange a reprint, an exchange, store credit, or a refund at no cost to you, in line with our Refund and Returns Policy. Please contact us within 48 hours of delivery for transit damage, and within 28 days for a fault appearing later. Photographs are required. Exchanges and store credit are available only for faults reported inside those windows, and never for a change of mind. Your right to reject a faulty item within 30 days is unaffected.

You will not normally be required to return a faulty item. Where we do request a return, we pay the return postage.

Arranging any return

All returns must be authorised in advance. Contact us by email and we will confirm the return and email you a return label to print. We do not publish a returns address, and contacting us first is what lets us cover the postage and refund you quickly. Our correspondence address is not a returns address, and anything sent there may be delayed or returned to you.

Refunds

Where you have cancelled under the change of mind right, refunds are made within 14 days of us receiving the item, or within 14 days of evidence that you have sent it, whichever is earlier. Because we issue the return label, the ParcelShop scan is that evidence and we see it ourselves, so you do not need to send us anything. Refunds are made to the original payment method.   1. Billing and Account Information

You agree to provide accurate, current, and complete:

  • Billing information.
  • Shipping address.
  • Contact details.

We may:

  • Refuse or cancel any order that appears fraudulent, suspicious, or in breach of these Terms.
  • Request additional information or documentation to verify an order.
  • Modify or cancel an order where there is a clear pricing, product-description, or payment error.

If an order is changed or cancelled, we will notify you by email. We do not use telephone or messaging apps for support.

  1. Payments and Security
  • Payments are processed securely through Stripe.
  • All transactions are encrypted in transit.
  • We do not store or have access to your full payment-card details.

By using the checkout, you confirm that:

  • You are authorised to use the payment method selected.
  • Any cardholder information you provide is correct and lawful.
  1. Intellectual Property

All designs, graphics, product artwork, descriptions, text, photographs, trademarks, and logos are the property of Romain Mas trading as Wise Monkey Wear® and are protected by UK and international copyright, design, and trademark law.

You may not:

  • Copy, reproduce, download, or redistribute any content without our prior written permission.
  • Use our trademarks, logos, or images in a way that suggests our endorsement of, or affiliation with, third-party products or services.
  1. User Comments and Submissions

By submitting reviews, comments, or ideas (for example on social media or on our website), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, and distribute that content in any medium, for any lawful purpose.

You must not:

  • Post unlawful, defamatory, offensive, or obscene material.
  • Infringe any third-party rights, including intellectual property or privacy rights.

We reserve the right to remove or edit any content that violates these Terms or applicable law.

  1. Third-Party Services and Links

Our store relies on third-party providers, including:

  • Payment processors, for example Stripe.
  • Shipping and couriers, for example Royal Mail for delivery and Evri for returns.
  • Fulfilment and print-on-demand services.
  • Analytics and marketing tools, where configured.

Each of these third parties operates under its own terms of service and privacy policy, which you should review separately. We are not responsible for the accuracy, conduct, or content of linked third-party websites or services.

  1. Privacy Policy

Your personal information is handled in accordance with our Privacy Policy. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Your personal data is not sold to third parties.

  1. Limitation of Liability

To the fullest extent permitted by law, Wise Monkey Wear (Romain Mas t/a Wise Monkey Wear®) shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or our products, including but not limited to:

  • Loss of profits, data, goodwill, or business opportunity.
  • Breach of contract, negligence, or other tortious claims.

In any event, our total liability to you for any claim arising under or in connection with these Terms shall not exceed the amount you paid for the relevant product.

Nothing in this section excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be limited or excluded under applicable law.

You agree to indemnify and hold harmless Romain Mas t/a Wise Monkey Wear®, its affiliates, employees, and partners from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms.
  • Your use of the website or products in a manner that violates applicable law.
  • Your infringement of any intellectual property, privacy, or other third-party right.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or modified to the minimum extent necessary to make it valid. The remaining provisions shall continue in full force and effect.

These Terms remain in effect unless terminated in accordance with their terms. We may suspend or terminate your access to the website or your account, and cancel any pending or recent orders, at any time and without prior notice, if you breach these Terms or engage in any activity that we reasonably consider to be abusive, fraudulent, or unlawful.

  1. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund and Returns Policy, and any other policies or notices posted on this site, constitute the entire agreement between you and Romain Mas t/a Wise Monkey Wear® (Wise Monkey Wear) regarding your use of this website and the purchase of our products. They supersede any prior or inconsistent statements or agreements.

  1. Governing Law and Jurisdiction

These Terms and all related disputes are governed by the laws of England and Wales. You agree to the exclusive jurisdiction of the courts of England and Wales for any claim or dispute arising out of or in connection with these Terms, the website, or your purchases, to the extent permitted by applicable law.

We may update these Terms from time to time. When we do, we will publish the new version on this page and update the “Last updated” date. Continued use of the website, or placing an order after changes have been published, constitutes your acceptance of the revised Terms.
